The legislative powers of component Nigerian states and the Federation, in connection with electricity, had always been in the Concurrent Legislative List of the Constitution of the Federal Republic of Nigeria 1999 (“CFRN”). However, until recently, state legislatures (also referred to, as States, in this piece) were only empowered to make laws on distribution- generally being a residual matter, and on generation and transmission, in areas not covered by a national grid system.
